INDIE BIRDS — DISTRIBUTION TERMS
Effective Date: 5 September 2026
These Distribution Terms govern the commercial distribution of a creator’s work through Indie Birds, a creator programme operated by Camran Films.
Please read these terms carefully before agreeing to distribution.
1. WHAT THESE TERMS ARE FOR
Indie Birds discovers and curates independent films and original video works for potential distribution through its digital channels, including YouTube and associated promotional platforms.
These Terms apply only when a creator’s work is accepted for Distribution.
Submitting a film for consideration does not itself create a distribution agreement or guarantee publication, monetisation, views or revenue.
2. THE CREATOR KEEPS OWNERSHIP
You retain ownership of the copyright and underlying intellectual property in your work.
Indie Birds does not acquire ownership of your film merely because you submit it or because it is selected for Distribution.
The rights granted to Indie Birds are limited to the rights necessary to distribute, present and promote the selected work under these Terms and any applicable individual agreement.
3. WHO CAN GRANT DISTRIBUTION RIGHTS
You must be the copyright owner or have the full authority necessary to grant the applicable distribution rights.
If the work has multiple copyright owners, producers, financiers, distributors or other rights holders, you must have authority to enter into the arrangement on behalf of all relevant parties.
If you are acting on behalf of another person or organisation, you confirm that you have authority to do so.
4. RIGHTS YOU MUST CONTROL
Before Distribution, you must have cleared all rights necessary for the proposed use of the work, including, where applicable:
- Music and sound recordings
- Footage
- Photographs
- Artwork
- Performances
- Voice recordings
- Stock material
- Fonts or other incorporated material
- AI-generated or AI-assisted material where applicable
- Location or other third-party permissions where required
You are responsible for retaining evidence of relevant licences, permissions and releases.
YouTube’s current monetisation policies require appropriate rights clearance, and third-party material can affect monetisation eligibility. (Google Help)
5. DISTRIBUTION LICENCE
For an accepted work, you grant Indie Birds the limited distribution rights expressly agreed for that work.
Unless a separate written agreement states otherwise, the intended arrangement is:
Platform: Indie Birds digital channels, including YouTube
Territory: Worldwide
Nature: Non-exclusive
Purpose: Distribution, presentation, promotion and monetisation of the selected work
The specific licence, duration and permitted uses will be confirmed before commercial publication.
Nothing in these Terms transfers copyright ownership to Indie Birds or Camran Films.
Under Indian copyright law, copyright licences should be in writing and the applicable rights, duration and territorial extent should be specified. (Copyright Office of India)
6. NON-EXCLUSIVITY
Unless expressly agreed otherwise in writing, the Distribution arrangement is non-exclusive.
You remain free to exploit your work elsewhere, subject to any specific rights or restrictions contained in the individual Distribution Agreement.
You must disclose any existing exclusive licence, distribution agreement or other contractual restriction that could prevent Indie Birds from distributing the work.
7. WHERE YOUR WORK MAY APPEAR
A selected work may be published through Indie Birds’ YouTube channel and may also be presented through associated Indie Birds digital and social channels where permitted by the applicable agreement.
Indie Birds may use:
- The complete work
- Trailer material
- Short excerpts
- Stills
- Poster artwork
- Thumbnail artwork
- Title and synopsis
- Creator name
- Director and cast/crew credits
- Creator biography
- Links to the creator’s approved website or social profiles
Such uses are for distribution, editorial presentation and promotion of the work and Indie Birds.
8. EDITORIAL CONTROL
Indie Birds is a curated platform.
Selection for Distribution does not mean that every submitted work will be published.
Indie Birds may consider:
- Originality
- Storytelling
- Creative voice
- Technical quality
- Audience suitability
- Editorial relevance
- Rights clearance
- Platform suitability
Indie Birds may decline a submission without being required to provide individual editorial feedback.
9. 80% CREATOR / 20% INDIE BIRDS
For an accepted Distribution title:
80% — CREATOR
20% — INDIE BIRDS
The creator receives 80% of Eligible Net YouTube Revenue actually received by the distributing party from the applicable work.
Indie Birds retains 20% of that Eligible Net YouTube Revenue.
This is a contractual revenue-sharing arrangement between the creator and Indie Birds. It is not YouTube’s own revenue-share percentage.
YouTube’s current Watch Page monetisation structure provides eligible YouTube Partner Programme creators 55% of net revenues from ads displayed or streamed on their public videos; Shorts use a separate revenue-sharing model. (Google Help)
10. WHAT “ELIGIBLE NET YOUTUBE REVENUE” MEANS
For these Terms, Eligible Net YouTube Revenue means revenue actually received by the distributing party that is attributable to the applicable Distribution title, after YouTube’s applicable revenue share and adjustments and excluding amounts that are not attributable to that title.
It may be affected by:
- YouTube adjustments
- Invalid traffic
- Refunds
- Chargebacks
- Content ID claims
- Copyright disputes
- Withheld amounts
- Taxes or withholding required by law
- Other platform adjustments
YouTube states that earnings can be withheld or adjusted in circumstances including invalid traffic, fake engagement and Content ID claims. (Google Help)
11. NO GUARANTEED REVENUE
Indie Birds does not guarantee:
- A minimum number of views
- Monetisation
- A particular CPM/RPM
- A minimum revenue amount
- A particular publication date
- Viral reach
- Advertising availability
YouTube determines monetisation eligibility and platform revenue according to its policies and systems. (Google Help)
12. YOUTUBE MONETISATION
A selected film may be monetised only where the applicable channel, video and rights situation satisfy YouTube’s requirements.
YouTube may:
- Approve monetisation
- Limit monetisation
- Disable monetisation
- Apply copyright claims
- Remove content
- Change monetisation eligibility
- Change applicable policies
Indie Birds cannot override YouTube’s decisions.
YouTube’s monetisation policies apply to the channel as a whole, including its rules concerning original/authentic content and reused content. (Google Help)
13. IMPORTANT: ORIGINALITY & PRESENTATION
Indie Birds intends to present selected works as part of an editorially curated creator platform.
Selection does not mean that Indie Birds will simply republish every submitted film without editorial consideration.
Indie Birds may create original titles, descriptions, thumbnails, introductions, promotional edits, creator profiles, contextual material or other presentation elements where appropriate.
The creator’s underlying film remains the creator’s work.
14. CREATOR CREDIT
Indie Birds will make reasonable efforts to provide appropriate creator and project credits.
Credits may include:
Film Title
Director / Creator
Writer
Producer
Cast / Key Contributors
Creator social or website links
Creators are responsible for providing accurate credit information.
15. PROMOTIONAL USE
You permit Indie Birds, within the scope of the applicable Distribution arrangement, to use reasonable excerpts, stills, artwork, trailers and creator information to promote:
- The selected work
- The creator
- Indie Birds
- The Distribution programme
Promotional material may appear on YouTube, Instagram, Facebook, websites and other Indie Birds-associated channels.
16. CHANGES TO THE WORK
Indie Birds will not materially alter the creative substance of the film without appropriate permission.
Reasonable technical or presentation adjustments may be made where necessary for:
- Platform requirements
- Formatting
- Subtitles
- Aspect ratios
- Audio levels
- Thumbnail creation
- Promotional clips
- Editorial presentation
17. PREVIOUSLY PUBLISHED WORK
Previously published work may be accepted.
You must disclose any existing:
- Exclusive distribution agreement
- Platform exclusivity
- Licence
- Copyright claim
- Revenue-sharing arrangement
- Other contractual restriction
Indie Birds may decline a work where existing rights prevent the proposed Distribution.
18. COPYRIGHT CLAIMS & DISPUTES
If a copyright owner or other rights holder raises a credible claim concerning a distributed work, Indie Birds may temporarily restrict, demonetise, suspend or remove the work while the matter is investigated.
Where appropriate, Indie Birds may request documentation from the creator.
The creator remains responsible for rights they represented that they owned or controlled.
19. CREATOR WARRANTIES
By entering into a Distribution arrangement, you represent and warrant that:
- You have authority to submit the work.
- The information you provided is accurate.
- You own or control the rights necessary for the agreed Distribution.
- Necessary third-party permissions have been obtained.
- The work does not knowingly infringe another person’s copyright or other rights.
- You have disclosed material existing agreements affecting the work.
- You will promptly inform Indie Birds if a material rights dispute arises.
20. INDEMNITY
To the extent permitted by applicable law, you agree to be responsible for claims arising from your breach of the rights, ownership or authority representations you make concerning the work.
This does not make you responsible for matters caused solely by Indie Birds’ independent actions outside the rights granted by you.
21. REPORTING & PAYMENTS
Where revenue is generated, applicable revenue information will be calculated from the records available to the distributing party.
Payments to creators will be made according to the payment schedule and minimum payment threshold stated in the applicable Distribution Agreement.
Where payment cannot reasonably be made because the creator has not supplied required payment information, the amount may remain payable until the information is provided.
Creators are responsible for their own applicable taxes and statutory obligations.
22. TAXES
Any tax withholding required by applicable law may be deducted before payment.
Creators are responsible for determining and meeting their own tax obligations arising from payments received under the Distribution arrangement.
23. WITHDRAWAL
Before a Distribution Agreement is accepted, a creator may request withdrawal of the submission.
After a Distribution Agreement has been accepted, withdrawal will be governed by the termination provisions of that agreement.
24. TERMINATION
Either party may request termination in accordance with the applicable Distribution Agreement.
Indie Birds may suspend or terminate Distribution where:
- Rights ownership is materially disputed
- Required rights cannot be verified
- The work violates applicable law or platform policy
- A serious copyright complaint arises
- The creator provided materially false information
- Continued distribution creates material legal or platform risk
Where reasonably possible, Indie Birds will communicate the reason for suspension or termination.
25. EFFECT OF TERMINATION
After termination, Indie Birds will cease new publication/distribution of the work within a reasonable operational period, subject to:
- Platform processing times
- Existing technical copies
- Legal obligations
- Archived records
- Previously published promotional material
- Any continuing rights expressly agreed in writing
Revenue generated before termination remains subject to the applicable revenue-sharing terms.
26. NO GUARANTEE OF CONTINUED AVAILABILITY
Indie Birds may change its programming, channel strategy, platform presence or distribution methods.
Accordingly, acceptance of a work does not guarantee that it will remain continuously available on any particular platform for a specific period unless that period is expressly agreed in writing.
27. CREATOR RELATIONSHIP
Distribution through Indie Birds does not make the creator an employee, partner, agent or joint venture partner of Camran Films.
The relationship is that of independent contracting parties for the limited purpose of the agreed Distribution.
28. CHANGES TO THESE TERMS
Indie Birds may update these general Distribution Terms for future submissions.
The terms applicable to an accepted Distribution title will be determined by the agreement accepted for that title.
Material changes affecting an existing Distribution arrangement will not automatically alter that arrangement unless agreed or permitted under the applicable agreement.
29. PRIVACY
Personal information collected during submission and Distribution administration will be handled in accordance with the applicable Camran Films Privacy Policy.
Only information reasonably necessary to administer submissions, communicate with creators, verify rights, publish selected works and manage the Distribution relationship should be collected.
30. GOVERNING LAW
These Terms and any Distribution Agreement entered into under them shall be governed by the laws applicable to the contracting parties and the applicable transaction, subject to mandatory rights and protections under applicable law.
31. THE IMPORTANT PART
Submitting a film is not accepting these Distribution Terms as a commercial licence.
Your submission allows Indie Birds to review and evaluate the work.
If Indie Birds wants to distribute the work, the creator will first receive the applicable Distribution Agreement setting out the specific commercial arrangement, including the agreed rights, duration, territory, revenue calculation, payment terms and termination provisions.
No commercial Distribution rights are granted merely by submitting the form.
32. ACCEPTANCE
By accepting a Distribution Agreement, the creator confirms that they have read and understood the applicable terms and have authority to grant the agreed rights.
